Scottish Government Increases Legal Aid Fees by 13% to Support Access to Justice

Recognising the challenges faced by legal aid solicitors and the communities they serve, the Scottish Government has announced a significant 13% increase in legal aid fees, set to take effect from September 2026. This move is part of a broader initiative to strengthen the legal aid system and ensure its sustainability.

For solicitors dedicated to providing legal aid, this fee increase is a welcome development. It acknowledges the vital role they play in representing individuals who might otherwise struggle to afford legal services. The adjustment aims to make legal aid work more financially viable for law firms, encouraging more practitioners to offer these essential services.

Beyond the fee increase, the government is introducing additional support measures. Funding will be provided for up to 40 Legal Aid Traineeship positions, fostering the next generation of solicitors committed to public service. Additionally, there will be digital support to help firms acquire technology that assists trainees in their work and court appearances. These steps are designed to modernise the legal aid system and make it more accessible and efficient.

Since 2019, cumulative fee increases have amounted to just over 25%, outpacing inflation. The most recent rise in April 2023 brought total additional funding to £31 million since 2019. This sustained investment underscores the government's commitment to ensuring that legal aid remains a robust pillar of the justice system.
