Access to justice is a cornerstone of a fair society, ensuring that everyone, regardless of their financial situation, can seek legal assistance when needed. Recognising the challenges within the current system, the Scottish Government has initiated a consultation aimed at reforming legal aid to make it more accessible and user-friendly.
Legal aid provides publicly funded assistance to individuals who cannot afford legal representation. It covers various areas, including family law, housing disputes, and criminal defence. However, the existing system has faced criticism for its complexity and inefficiencies, prompting the need for reform.
The consultation, which closed on 13 October 2026, sought input on proposals to modernise the legal aid framework. Key objectives include simplifying processes, reducing duplication, and enhancing decision-making speed. By streamlining these procedures, the government aims to improve access for those in need and grant greater autonomy to accredited solicitors. This initiative builds upon previous actions, such as a 13% increase in solicitor fees implemented in September 2026 and the establishment of a £1.5 million Legal Aid Traineeship Fund supporting up to 40 trainees across Scotland.
Despite these efforts, concerns persist regarding the availability of solicitors willing to undertake legal aid work. Reports indicate that individuals, particularly those seeking civil protection orders, struggle to find representation. Factors contributing to this issue include low remuneration rates, making complex cases financially unviable for many practitioners. The Scottish Legal Aid Board has highlighted the need for "transformational change" to address these challenges effectively.
At Thompson Family Law, we understand the importance of accessible legal services. Our commitment to supporting clients through family law matters remains steadfast. We encourage those facing legal challenges to reach out, ensuring that financial constraints do not hinder access to justice.
As the legal aid reform progresses, we remain hopeful that the proposed changes will lead to a more equitable system, allowing all individuals to receive the legal support they deserve.
