My marriage has broken down - what are my options?

For most families going through divorce or separation, it is a difficult and stressful time. While some divorces may proceed amicably, it can be the case that a dispute arises. If you are dealing with disputes throughout your divorce process, there are options available to you.

Do I require legal advice?

It is often the case that disputes can be resolved by the couple themselves, either directly or through a third party, such as a friend or family member. However, if the dispute involves large amounts of money or assets, it is advised that legal advice is taken.

Mediation

Mediation is when the involved parties meet with a trained mediator to work out the issue. The mediator's purpose is not to give legal advice or show favour to one side, but rather to help the parties come to the best solution.

Collaboration

If mediation does not yield a solution, then the collaborative process can be used. This is a more formal type of dispute resolution, where four people are involved (the two people getting divorced/separated and their lawyers) working together to try and agree on the best outcome.

This is a good alternative for both parties to reach a conclusion without going to court.

Arbitration

Arbitration is another option if the collaboration process fails to produce an agreement.

This process is similar to that of the court, but it differs as the parties choose who their arbitrator will be. The advantage of this is that a binding decision will always be given.

Will I need to go to court?

The last option would be to take the case to court. The advantage of this choice is that the decision will be enforceable. The disadvantages would be that court hearings have to be scheduled into the court timetable, which can significantly delay the process as you wait for dates for hearings, and it can be expensive.
